Top of the Continental Divide

The top of the Continental Divide as seen from Berthoud Pass. This is the dividing line between water headed to the Pacific (Colorado River) from water headed to the Atlantic (Platte River) – James Peak and Indian Peaks Wilderness Areas. How much and where water falls (or accumulates as snow) is closely watched by Colorado and all the western states. It is by far the most important commodity, impacting everyone and everything. The first legislation governing water in Colorado was the 1861 Colorado Territorial Act, passed during the very first session of the Colorado Territorial Legislature. Today, water is running short, and laws passed over the past hundred years are no longer adequate to govern the process. Most accept the lack of water issue is now in a state of crisis.
